Terms of Use

These Terms of Use apply only to the ToneScribe apps for iPhone and Mac distributed through Apple’s App Store (together, the “Apps”). By downloading, installing, or using an App, you agree to these Terms. If you do not agree, do not use the Apps. These Terms form an agreement between you and Rahul Singh, the independent developer of ToneScribe (“we”, “us”, “our”).

The Apps are licensed under Apple’s Standard Licensed Application End User License Agreement (“Standard EULA”). These Terms supplement, and do not replace, the Standard EULA. If these Terms conflict with the Standard EULA, the Standard EULA controls. These Terms are concluded between you and Rahul Singh, not Apple Inc. Apple has no obligation to provide maintenance or support for the Apps. Apple’s responsibilities, including any applicable warranty refund obligation, are governed by the Standard EULA and applicable law.

Subject to these Terms, the Standard EULA, and Apple’s Usage Rules, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Apps on Apple-branded devices that you own or control for personal, professional, or internal business purposes. You may not resell, sublicense, rent, commercially distribute, or provide the Apps as a hosted, bureau, or competing service. Family Sharing and other permitted access are governed by Apple’s Usage Rules.

ToneScribe is a private, local-first voice transcription product for iPhone and Mac. It lets you dictate into other apps, record speech, import supported audio or video that you select, transcribe on-device, and manage local transcript history and related writing tools. The iPhone App can provide an optional custom keyboard, and the Mac App can use Accessibility permission for global shortcuts and text insertion. No ToneScribe account is required. Voice audio, imported media, keyboard context, clipboard content, and written content are not sent to our servers for transcription.

The free version includes a rolling seven-day transcription allowance. The allowance is currently 1,000 words on iPhone and 2,000 words on Mac. A cycle begins with the first transcription after a reset and renews seven days later. We may adjust free allowances in future versions with reasonable notice where appropriate.

ToneScribe offers an optional one-time, non-consumable ToneScribe Pro purchase that unlocks unlimited transcription in the supported ToneScribe Apps for iPhone and Mac when Apple makes the purchase available to the same Apple Account. The price displayed by the App Store before confirmation is the price that applies; local prices and taxes may vary. Payment is charged to your Apple Account when you confirm the purchase. This purchase does not renew automatically and does not create a subscription. Active legacy monthly or annual subscriptions remain valid until the end of their paid term. Purchases are processed by Apple, validated through RevenueCat on iPhone, and validated directly through StoreKit on Mac.

“Lifetime” describes the duration of the non-consumable entitlement for the purchased product. It does not mean the lifetime of any person, guarantee that the Apps will remain available or compatible indefinitely, or automatically include a separate future product. Nothing in this paragraph limits any non-excludable consumer right or Apple refund remedy.

We do not issue App Store refunds directly. Refund eligibility and requests are handled by Apple under its policies and applicable consumer law, normally through Apple’s Report a Problem service. Nothing in these Terms limits any refund or consumer right that cannot legally be excluded.

You can use “Restore Purchases” to recover an eligible ToneScribe Pro purchase after reinstalling or when using another supported device with the same Apple Account. Restoration and cross-device availability remain subject to Apple’s App Store rules and the availability of the relevant ToneScribe App.

• You retain ownership of the transcriptions, notes, snippets, dictionary entries, and other content you create in the Apps. ToneScribe claims no ownership of content or media you provide.
• Voice audio and imported media are processed through temporary local files that are deleted after transcription or cancellation. Saved transcripts and writing content remain local on your device.
• You are solely responsible for backing up your data. iCloud or device backup may preserve eligible local user content, but downloadable speech-model files are excluded and can be downloaded again.
• You are responsible for the legality of what you record. You must obtain the consent of all parties before recording conversations where required by applicable law.
• You represent that you have the necessary rights to import, process, copy, or share any audio, video, text, or other content you provide.

You agree not to:

• Use the Apps for any unlawful purpose or in violation of applicable laws
• Record or transcribe conversations without the knowledge or consent of all parties where required by law
• Use the Apps to store or distribute harmful, misleading, or abusive content
• Reverse engineer, decompile, or disassemble any part of the Apps except where applicable law expressly permits it
• Attempt to circumvent or tamper with the Apps’ purchase verification or feature gating
• Use the Apps in any way that could damage, disable, or impair their functionality

The Apps, including their design, code, and graphics, are owned by Rahul Singh or our licensors and are protected by copyright and other intellectual property laws. The on-device transcription engine and other third-party components remain the property of their respective licensors. Nothing in these Terms grants you any rights to our intellectual property beyond the limited licence in Section 3. If you believe content in an App infringes your intellectual property rights, please contact us at support@tonescribe.com.

Your use of the Apps is also governed by our Privacy Policy, which is incorporated into these Terms by reference. In summary, transcription and personal content remain on-device. Limited purchase information is processed by Apple and RevenueCat, and support information is sent only when you choose to contact us.

The Apps use FluidAudio’s Parakeet speech recognition engine for on-device transcription. Speech-model files may be downloaded from infrastructure operated by FluidInference or its hosting provider, such as Hugging Face; model-download requests contain no voice, imported media, keyboard context, clipboard content, or written content from ToneScribe. RevenueCat is used on iPhone for purchase validation and entitlement management, while the Mac App validates ownership directly through Apple StoreKit. Use of those external services is also subject to their applicable terms and privacy policies.

To the maximum extent permitted by applicable law, the Apps are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that transcriptions will be perfectly accurate, that the Apps will be uninterrupted, compatible with every device or third-party app, or error-free, or that defects will be corrected. You are responsible for reviewing transcription output before relying on, publishing, or acting on it.

To the maximum extent permitted by applicable law, Rahul Singh shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of data, revenue, or goodwill, arising out of or in connection with your use of the Apps, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the Apps shall not exceed the amount you paid for the Apps in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be excluded under applicable law, including consumer protection rights.

We may update or discontinue an App, subject to applicable law and any non-excludable consumer rights. Your licence may terminate if you breach these Terms. Since user content is stored locally on your device, deleting an App will permanently remove its local transcript history, notes, snippets, dictionary entries, and settings unless preserved by an eligible device backup. We are not liable for data loss resulting from App deletion, backup failure, or device failure to the extent permitted by law. Sections 9, 11, 14, 15, and 17 survive termination.

These Terms are governed by the laws of India, without regard to conflict-of-law principles, and disputes shall be subject to the courts with competent jurisdiction in West Bengal, India. This choice does not deprive you of mandatory consumer protections or a forum that applicable law gives you in your place of residence.

We may update these Terms when the Apps, purchases, or applicable requirements change. We will post the updated version with a revised “Last updated” date and make reasonable efforts to notify you of material changes. Where required by law, we will ask you to accept revised Terms. Otherwise, revised Terms apply prospectively from their stated effective date, and continued use after that date constitutes acceptance.
